Privacy Policy

This Privacy Policy describes the privacy practices of Goodchild Media trading as Jidori in connection with any of the Goodchild Media third party developed mobile Application partners (the “Apps”) including shared.gallery websites (the “Sites”).

Key Points:

  • The Apps & the Sites are for creating, uploading, viewing, displaying, sharing photos & videos as well as the collection, arrangement, and management of guest contact data for the management of events.

  • We use third-party cloud providers to store, process, edit, and share photos & videos. See “Third-Party Platforms and Applications” below for the list of providers.

  • With default settings, the Apps upload to the cloud all of the photos & videos that are taken during an event. We can use settings in the Apps to turn off uploads. Sharing photos & videos requires that they are uploaded.

  • Photos & videos are publicly accessible on the Sites once uploaded. The public links that lead to these photos & videos are intentionally hard to guess.

  • We may when agreed by you via our terms and conditions collect your photo information to publicly share with any third parties for the purposes of marketing or promotion.

Personal Information We Collect

When you use the Apps or Sites, we may collect information about you, including:

  • Photos & videos taken using the photobooth and the Apps at events where our software is used to run the photobooth. We obtain only the specific images you chose to participate in; we do not collect your photo if you do not participate in the photobooth. Please note that while we do not require or request any metadata attached to the photographs you upload, metadata (including, for example, geotags) may be associated with your photographs by default. We may take steps to delete any metadata that may be associated with a photograph you provide when you use the Apps.

  • Apps usage information, such as information about how you use the Apps and interact with us, including your preferred language, the date and time when you first installed the Apps and the date and time you last used the Apps.

  • Device data, such as your computer and mobile device operating system type and version number, manufacturer and model, device ID, push tokens, Google Advertising ID, Apple ID for Advertising, browser type, screen resolution, IP address (and the associated country in which you are located), the website you visited before visiting our Site; and other information about the device you are using to visit the Apps.

How We Use Your Personal Information

To operate and improve the Apps/Sites: Enable you to use the Apps/Sites’ features.

Communicate with you about the Apps/Sites, including by sending you announcements, updates, and security alerts, which we may send through a push notification, and responding to your requests, questions and feedback;

Provide technical support and maintenance for the Apps/Sites; and Perform statistical analysis about use of the Apps/Sites (including the use of Google Analytics).

Build new features, including training models on data you submitted.

To send you marketing and promotional communications. We may send you marketing communications as permitted by law. You will have the ability to opt-out of our marketing and promotional communications as described in the Opt Out Marketing section below.

For compliance, fraud prevention, and safety. We may use your personal information and disclose it to law enforcement, government authorities, and private parties as we believe necessary or appropriate to: (a) protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims); (b) enforce the terms and conditions that govern the Service; and (c) protect, investigate and deter against fraudulent, harmful, unauthorized, unethical or illegal activity.

With your consent. In some cases, we may specifically ask for your consent to collect, use or share your personal information, such as when required by law.

To create anonymous, aggregated or de-identified data. We may create anonymous, aggregated or de-identified data from your personal information and other individuals whose personal information we collect. We make personal information into anonymous, aggregated or de-identified data by removing information that makes the data personally identifiable to you. We may use this anonymous, aggregated or de-identified data and share it with third parties for our lawful business purposes.

How We Share Your Personal Information

Affiliates: We may share Apps usage information with our subsidiaries and affiliates, for purposes consistent with this Privacy Policy.

Service providers: We may share your personal information with service providers that perform services on our behalf or help us operate the Apps (such as customer support, hosting, analytics, email delivery, marketing, and database management services). These third parties may use your personal information only as directed or authorized by us and in a manner consistent with this Privacy Policy and are prohibited from using or disclosing your information for any other purpose.

Advertising partners: We may use third-party cookies and similar tracking technologies, which allow our advertising partners to collect information from your device. This helps us analyze how the Site and Apps are used, display relevant advertisements within the Apps, and promote the Site and Apps across other online platforms. Please note that your photos will never be used in advertising unless you have explicitly consented to such use by accepting specific terms and conditions provided to you in advance.

Third-party platforms and social media networks: If you have enabled features or functionality that connect the Apps to a third-party platform or social media network (such as by logging into the Apps using your account with the third-party, providing your API key or similar access token for the Apps to a third-party, or otherwise linking your account with the Apps to a third-party’s services), we may disclose the personal information that you authorized us to share (such as when you elect to upload a photograph or video to your social media account). We do not control the third-party platforms’ use of your personal information, which is governed by that third party’s privacy policy and terms and conditions.

Professional advisors: We may disclose your personal information to professional advisors, such as legal advisors, bankers, auditors and insurers, where necessary in the course of the professional services that they render to us.

For compliance, fraud prevention and safety: We may share your personal information for the compliance, fraud prevention and safety purposes described above.

Business transfers: We may sell, transfer or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution.

Compliance with Law: We may be required to use and share your personal information to comply with applicable laws, lawful requests, and legal process, such as to respond to subpoenas or requests from government authorities.

Your Choices: In this section, we describe the rights and choices available to all users.

How did you get my consent? When you download the Apps and open them agreeing to the terms of use or access the Sites you indicate your consent.

Opt out of marketing communications and other push notifications You may opt out of marketing-related communications and other notifications we may send you via push notification by changing the settings on your mobile device or emailing hello@jidori.studio

Device permissions: You may revoke any permissions you previously granted to us through the settings on your mobile device or by emailing hello@jidori.studio

Cookies & Browser Web Storage: Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, the Site may not work properly. Similarly, your browser settings may allow you to clear your browser web storage.

Targeted online advertising: Some of the business partners that collect information about users’ activities on or through the Site or Apps may be members of organizations or programs that provide choices to individuals regarding the use of their browsing behaviour or mobile application usage for purposes of targeted advertising.

In addition, your mobile device settings may provide functionality to limit our, or our partners’, ability to engage in ad tracking or targeted advertising using the Google Advertising ID or Apple ID for Advertising associated with your mobile device.

Choosing not to share your personal information: Where we are required by law to collect your personal information, or where we need your personal information in order to provide the Apps to you, if you do not provide this information when requested (or you later ask to delete it), we may not be able to provide you with our services. We will tell you what information you must provide to use the Apps by designating it as required at the time of collection or through other appropriate means.

Third-party platforms or social media networks: If you choose to connect to the Apps via a third-party platform or social media network, such as by using Facebook login, you may have the ability to limit the information that we may obtain from the third-party at the time you login to the Apps using the third-party’s authentication service or otherwise connect your account. Subsequently, you may be able to control your settings through the third-party’s platform or service. For example, you may access and change your settings through the Facebook settings page for Apps and Websites. If you withdraw our ability to access certain information from a third-party platform or social media network, that choice will not apply to information that we have already received from that third party.

Our Apps’ Options: By default, the Apps upload all photos & videos taken at an event to the cloud-based services/platforms mentioned in this policy. The photos & videos are then exhibited in the online gallery, but this gallery is not available to the public as no persons (save and except our team) have access to this gallery unless they have (via being the user) or are given a link to the gallery (discussed below). The links to view galleries are hard to guess (long and randomized).

Email and SMS Sharing: Notwithstanding the above, the Apps are configured to allow email and SMS sharing which may affect what photos & videos are public. If photos or videos are shared via the email and/or SMS pathways, the photos/videos transition from private to public, as anyone with the link can access and download all of the photos & videos contained within the gallery.

Privacy Option: Users have the option to configure the event and turn on “gallery privacy”, which means that links sent in email and/or SMS will show the photos & videos of the specific guests but do not allow the entire gallery to be visited at once.

Other Sites, Mobile Applications and Services: The Apps & Sites may contain links to other websites, mobile applications, and online services operated by third parties. These links do not constitute an endorsement of, or imply affiliation with, any third party. Additionally, our content may appear on websites, mobile applications, or online services that are not associated with us. We do not control third-party platforms and are not responsible for their actions. Other websites, applications, and services may have different rules regarding the collection, use, and sharing of your personal information. We encourage you to review the privacy policies of any third-party services you use.

Third-Party Platforms and Applications

The Apps & Sites use the following third-party services to support their functionality:

  • Hosting:Vercel
  • Storage & Processing: Google Cloud (including Firebase)
  • Email: Amazon AWS
  • SMS, WhatsApp: Twilio
  • Crash Processing: Sentry.io
  • Payment Processing: Stripe

Crash Data: Anonymous crash data may be automatically uploaded via Google Firebase Crashlytics and Sentry.

Third-Party Policies: Generally, third-party providers used by the application collect, use, and disclose your information only to the extent necessary to perform the services they provide. However, each provider maintains its own privacy policies. We recommend reviewing their privacy policies to understand how your personal information may be handled.

Security Practices: We implement commercially reasonable security practices to protect data collected through the Apps and take steps to verify your identity before granting access to your account (if applicable). However, Goodchild Media cannot guarantee the security of any information you transmit to us or ensure that the data on the Apps is completely protected from unauthorized access, disclosure, alteration, or destruction.

Please help us protect your data by maintaining the confidentiality of your login credentials and device access. Changes in your connected social media services may also affect your privacy settings. We are not responsible for the privacy, security, or functionality of third-party organizations.

Retention: We configure our cloud-based storage to retain photos and videos for a duration (“N” days) defined by your subscription level. After this period, the media maybe used for ongoing marketing and promotional purposes.

User-generated content, including photos, videos, and other media, may be removed if it violates our Terms of Use.

We retain non-media personal data only for as long as necessary to fulfil the purposes outlined in this Privacy Policy. You may request deletion of your personal information by contacting us through the methods listed in this policy.

The Right to be Forgotten : You may request complete deletion of your personal data, including your account and email address, at any time. To do so, contact us using the methods provided in this policy. Please note that account deletion is permanent and cannot be undone.

Cross-Border Data Transfers Using third party partners we store data on Amazon Web Services and Google Cloud Platform, designating the United States as the storage location. Your personal information may be accessed by our service providers or technical support teams in regions outside your province, state, or country.

Notice to European Users: This section applies to individuals residing in Europe. Personal information: References to “personal information” refer to “personal data” under European data protection laws.

Controller: Goodchild Media is the controller of your personal data under this Privacy Policy.

Legal bases for processing: We process your data only as permitted by law.

 

Your Rights: If you reside in the European Union, you may request the following:

  • Access: Information about our processing and a copy of your data.
  • Correction: Fix any inaccuracies in your personal data.
  • Deletion: Erase your personal data.
  • Transfer: Receive or transfer your data in a machine-readable format.
  • Restriction: Limit our use of your data.
  • Objection: Object to data processing based on our legitimate interests.

Changes to the Privacy Policy: We reserve the right to update this Privacy Policy at any time. If changes are significant, we will notify you by updating the date of the policy and posting it on the Apps and/or Sites. We may also notify you through other appropriate means, as required by law.

All modifications take effect once posted unless otherwise stated. Continued use of the Apps following any update indicates your acceptance of the revised terms.
